We have been conducting market research for over 50 years. Our clients encompass over 2,000 businesses, including many Fortune 500 companies. Subscription Video Track ("Subscription Video Track") is a consumer research platform of NPD that gathers the viewing information of consumers located in the United States.

What Is Personal Information

Personal Information means information that directly identifies you or that may reasonably be used to identify you as a specific individual.

What Types Of Information We Collect And Process About You

The information we collect from you depends on how you interact with us. We collect information from Website visitors, and from individuals who provide survey responses and, when applicable Viewing Account Information.

Information That You Submit to NPD

1. Subscription Video Track Panelist Eligibility Information

In order to qualify to be a Subscription Video Track panelist, you must first complete our qualification survey. This requires you to provide certain personal and demographic information such as your age, gender, zip code, race, ethnicity, household size, household income range and age of children in household and certain viewing information, such as the viewing services to which you subscribe (e.g., streaming services, cable, satellite, etc.), any premium channels to which you subscribe, and your movie-going and DVD-buying frequency. Based on this information, we will determine if you are eligible to become a Subscription Video Track panelist. If so, we will ask you whether you will provide us with your streaming services user name and password. If not, you will not be eligible to become a Subscription Video Track panelist, we will not collect any additional information from you other than what we have already collected, and the information we automatically collect via our Website (as described below). We will retain the information we have collected, which will be subject to this Notice (see How Long You Retain My Information). If you are willing to provide us with your streaming services user name and password, you will be registered as a Subscription Video Track panelist.

2. Viewing Account Information

After you have provided the Subscription Video Track Panelist Eligibility Information, we will ask you to identify the platform(s) you use to view streamed video content (the "Viewing Account") and provide information concerning your Viewing Account(s), including but not limited to the steaming service access credentials ("Viewing Account Information"), which we will use to automatically collect information directly from your Viewing Account ("Viewing Information"). "Viewing Information" includes account and profile ID number (and whether the profile ID is tagged as belonging to a child), titles and episodes viewed including names, dates, times and how much content was viewed, whether the streaming account is ad supported or includes additional channels, viewer Internet Protocol (IP) address, and the date you subscribed to the service. We will continue to collect your Viewing Information, including your current and historical View Information until you tell us you no longer want us to do so, which you may do at any time (see How To Opt Out). Please note that we may use a service provider to collect the Viewing Information on our behalf.

Automatically Collected Information

We may collect information automatically through your use of the Website, such as information about your device and device capabilities including, without limitation, the device operating system, Internet Protocol (IP) address, device type, time zone and other information that alone or in combination may be used to uniquely identify your device. The specific technology that may be employed is described below:

1. Cookies

A "cookie" is a small file containing a string of characters that is sent to your computer or device when you visit a website. When you visit the website again, the cookie allows that site to recognize you from previous visits. Among other things, cookies may store user preferences and other information. Our third party panel recruiters employ cookies on our Website to collect information relating to recruitment promotions in which they are involved. We do not otherwise currently use cookies, but reserve the right to do so in the future; please (see Changes To This Notice)

Most web browsers automatically accept cookies, but if you prefer, you can edit your browser options to block them in the future. The Help portion of the toolbar on most browsers will tell you how to prevent your computer from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether.

Information We Collect From Third Parties

  • We will collect Viewing Information from the streaming service for which you have provided Viewing Account Information as described above.

  • We may receive information about you from third party companies that specialize in collecting publicly available information. This may include estimated demographic information and information from public registers, such as the electoral register.

  • We may receive information about you from other sources. This may include demographic information from data collection companies and others in order for us to offer anonymous market research reports to clients and partners.

 

Where permitted by law, we may link the information about you that we collect from all of these sources with the information that we collect about you.

How We Use Your Information

We may use your personal information for the following purposes:

  • Generally, in our market research business to help clients and commercial partners better understand consumer behavior.

  • To communicate with you, to respond to your inquiries, and for other customer service purposes.

  • For promotional purposes. For example, we may use your information, such as your email address, for special offers, and promotions, or to otherwise contact you about information we think may interest you.

  • To fulfill rewards.

  • To better understand how users access and use our Website, both on an aggregated and individualized basis, in order to improve our Website and respond to user desires and preferences, and for other NPD research and analytical purposes.

  • To manage, protect against, and investigate fraud, risk exposure, claims, and other liabilities.

  • To comply with federal, state, or other applicable laws and regulations.

  • To the extent we deem it necessary or appropriate, to enforce or apply our rights under our agreement with our users, and/or protect the property, rights or safety of our users, NPD, or others.

 

How We Share Your Information

We may share your information, including your personal information, as follows:

  • Service Providers. We may disclose the information we collect from you to third party vendors, technology and other service providers, and contractors or agents who perform functions on our behalf, or are engaged with us. For example, we use service providers to extract and process the Viewing Information and to fulfill any rewards. These service providers are allowed to access and use the information we make available to them only as needed to perform their functions and for no other purposes.

  • Commercial Partners and Other Third Parties. In connection with our business, we may disclose demographic information (e.g., gender, household size, income range and number of children) to commercial partners and other third parties in either single or aggregate summary form and may also provide other aggregate or de-identified information to such third parties. Singular summary form includes demographic information about a person without specifically identifying the person. For example, this summary does not contain personal information such as an email address, nor does the combination of demographic information make it readily possible to identify the person. Aggregate summary includes demographic information about a group of persons without specifically identifying any person within the group. We also provide your Viewing Information and your personal information to commercial partners and other third parties, such as retailers or brands, for marketing research and analytics purposes (for example, to create models that estimate consumer preferences in the total population or to inform market segments). In that case, we will take steps designed to ensure that your personal information is handled securely and is treated at least as protectively as under this Notice. We will not, however, allow such third parties to use your Viewing Information and your information for the purposes of individually marketing to you or to contact you.   • Affiliates. We may disclose the information we collect from you to our corporate affiliates or subsidiaries; however, if we do so, their use and disclosure of your personal information will be subject to this Notice.

  • Business Transfers. If we are acquired by or merged with another company, if substantially all of our assets are transferred to another company, or as part of a bankruptcy proceeding, we may transfer the information we have collected from you to the other company.

  • In Response To Legal Process. We also may disclose the information we collect from you in order to comply with the law, a legal proceeding, court order, or other legal process, such as in response to a court order or a subpoena.

  • To Protect Us And Others. We also may disclose the information we collect from you where we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, violations of our Terms of Service or this Notice, or as evidence in litigation in which NPD is involved.

 

How We Protect Your Personal Information

We have implemented reasonable precautions to protect the information we collect from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. Please be aware that despite our efforts, no data security measures can guarantee 100% security. You should take steps to protect against unauthorized access to your password, phone, and computer by, among other things, signing off after using a shared computer, choosing a robust password that nobody else knows or can easily guess, and keeping your log-in and password private. We are not responsible for any lost, stolen, or compromised passwords or for any activity on your account via unauthorized password activity. Does NPD Collect Information From Minors?

We do not knowingly collect personal information from individuals who are under the age of 16. If you are under 16 years old, you may not participate in Subscription Video Track. If we become aware that we inadvertently collected personal information from anyone under the age of 16 or if you have reason to believe that a child under the age of 16 has provided personal information to us, please contact us and we will promptly delete such personal information.

How Long You Retain My Information

We will retain your information for as long as we are offering Subscription Video Track or a successor service and for one (1) year thereafter. However, we may retain and use your information for more than 5 years as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. How To Opt Out

  • To opt-out of our sharing of your personal information as described under "Commercial Partners and Other Third Parties" above, send an email to streaming.support@npd.com. Please note that it may take up to 10 business days for us to process opt-out requests.

  • To opt-out of being a panelist of Subscription Video Track, send an email to streaming.support@npd.com and request to be deactivated. Please note that it may take up to 10 business days for us to process opt-out requests. By opting-out, Viewing Information is no longer collected as from effective date of opt-out, but Viewing Information and personal information will be retained in accordance with How Long You Retain My Information

 

Changes To This Notice

This Notice is current as of the Last Updated date set forth above. We may change this Notice from time to time, so please be sure to check back periodically. We will post any changes to this Notice on our Website. If we make any changes to this Notice that materially affect our practices with regard to the personal information we have previously collected from you, we will provide you with notice in advance of such change by sending you an email at the address you have provided.

A. California Consumer Privacy Act (CCPA)

The California Consumer Privacy Act (CCPA) requires businesses to provide California consumers with the following information about how the business processes their personal information and the rights available to them with respect to their information.

Categories of Personal Information that We Collect and Use

The categories of personal information about California consumers that we have collected in the preceding 12 months are as follows:

 

NAME, CONTACT INFORMATION AND IDENTIFIERS: unique personal identifier (Subscription Video Track ID number), online identifier, Internet Protocol (IP) addresses, email address, account name, or other similar identifiers.

PROTECTED CLASSIFICATIONS: characteristics of protected classifications under California or federal law such as race, gender, or age.

PURCHASE HISTORY AND TENDENCIES: commercial information including video titles viewed, date and time of viewing or other purchasing or consuming histories or tendencies.

USAGE DATA: internet or other electronic network activity information, including, but not limited to, information regarding a consumer’s interaction with the Website.

We use this information as described above in How We Use Your Information.

California Consumer Rights

Under the CCPA, California consumers have the following rights:

  • Request up to twice every 12 months information about our collection and use of your personal information over the prior 12 months, including

    • what personal information we collect, use, disclose, or sell about you

    • the specific pieces and categories of personal information we collected about you

    • the categories of sources of the personal information we collected about you

    • the categories of third parties to whom the personal information was disclosed or sold

    • our business purpose for collecting or selling the personal information

  • Request deletion of your personal information that we have collected about you, subject to certain exemptions.

  • Not receive discriminatory or adverse treatment for exercising these rights.

Submitting Requests. You can submit requests for access to and deletion of your information online by filling our Request Forms here, or by contacting us at 833-775-0019 (toll free). All requests must be verifiable in accordance with the CCPA.

Incentives and Discrimination. We offer a financial incentive in return for the sharing of your information. The incentive we offer is a financial reward in exchange for the disclosure of certain information we collect directly from you (stated above), as well as from your Viewing Information. We will not discriminate against you if you exercise your CCPA rights.

 

B. Shine the Light Law. California residents may request a list of certain third parties to which we have disclosed personally identifiable information about them for those third parties’ own direct marketing purposes. You may make one request per calendar year. In your request, please attest to the fact that you are a California resident and provide a current California address for your response.
